01
Acceptance and scope
These Terms & Conditions describe use of the Bin and Gone website and the process for requesting and reviewing junk removal, cleanout, related project or mini-bin services. They apply to website and inquiry use, but they do not by themselves create a service contract.
These Terms do not replace the written estimate, booking confirmation, change approval or project-specific terms accepted for a job. A service contract is formed only through explicit acceptance of the project-specific record. If that record conflicts with general website information, the accepted project record controls for that job, subject to applicable law. Nothing in these Terms removes a consumer right that cannot legally be waived.
02
An inquiry is not a booking
Submitting information, preparing a text, calling, emailing, sending photos, asking for availability or receiving a response does not reserve a crew, vehicle, date, arrival time or mini-bin. The website does not automatically accept orders or process payments.
A booking exists only after Bin and Gone confirms the customer, service location, authorized scope, included and excluded items, access, timing, price and any other material conditions, and the customer accepts those details. Until that confirmation, either party may decide not to proceed.
03
Service area and availability
Orono, Newcastle, Bowmanville and Courtice are the confirmed core service communities. Nearby locations may be reviewed using the exact address or postal code. A city name, website page or service-area selection does not guarantee availability for every address or project.
Weekend service is available, and premium same-day service may be available depending on the location, crew, vehicle, materials, scope, access and requested timing. Same-day service is never guaranteed by the website. Any premium or special timing must appear in the confirmed project details.
04
Free estimates and pricing
Estimate reviews are free. Light pickups start at $200. This is a starting price, not a fixed offer for every job. Larger or specialty projects are assessed using the items or volume, material type, access, carrying and handling difficulty, safety requirements and agreed scope.
Photos, descriptions and measurements help the review but can be incomplete. An estimate assumes that the customer’s information is accurate and that the items, quantity, materials and access match what was disclosed. If a material difference is discovered, Bin and Gone will provide a revised written estimate or change description and obtain the customer’s written approval before performing added work or charging an added amount. The customer may decline the revised work.
05
Written booking details
A confirmed booking will identify the contracting legal supplier and operating name, required supplier contact details, customer, service location, work authorized, included and excluded items, in-home or curbside handling, access conditions, performance date or arrival window, itemized price or pricing method, applicable taxes, payment terms, cancellation or refund terms and any approved special conditions.
Before accepting, the customer will have an express opportunity to review the details, correct errors, accept or decline. A retainable written copy will be provided after acceptance within the period required by law. Work outside the confirmed scope requires separate written approval. Marketing copy, an example image, a guide or a starting price does not add work to a confirmed booking.
Where relevant, the project record must also address final identification of items to keep or remove, when removed items can no longer be retrieved, any donation, recycling or disposal understanding, pre-existing damage, and the process for reporting a property concern.
06
Customer authority and access
The customer confirms that they own the items or are authorized by the owner, tenant, executor, landlord, property manager or other responsible person to approve access and removal. The customer must clearly identify what is to be removed and what must remain.
Before service, tell Bin and Gone about stairs, elevators, narrow doors, long carries, parking restrictions, keys, gates, fragile surfaces, pre-existing damage, unusually heavy objects, utilities and other known hazards. Arrange any required building access or authorized representative, and keep children, pets and unnecessary people clear of the work area. Bin and Gone may pause or refuse work when authority, access or safety is uncertain.
07
Accepted, excluded and unsafe materials
Bin and Gone removes agreed items and ordinary materials that can be handled and transported safely. Chemicals, hazardous materials and cinder blocks are not accepted. Concrete, soil, fuel, propane, asbestos concerns, liquids, paint, batteries, pressure vessels, sharp objects, regulated waste and unusually heavy material must be identified before booking and may be declined.
The list in the confirmed booking controls. If excluded, unsafe or undisclosed material is found, Bin and Gone may stop or limit the work. Refused material remains the customer’s responsibility for lawful handling. No changed work or added charge is automatically authorized by these Terms.
08
Light demolition and tear-down requests
Only selected small, non-structural tear-down requests are considered, case by case. Selecting light demolition on the website does not confirm that a project is suitable. The exact item or structure, utilities and disconnection status, materials, access, debris and cleanup scope must be reviewed in advance.
The project confirmation must state who is responsible for any required permit, utility work or specialist assessment. Structural work and undisclosed hazardous or regulated material are not included. Bin and Gone may decline or stop a project that falls outside the confirmed scope or cannot be performed safely.
09
14-yard mini-bin inquiries
The website shows and labels a photographed 14-yard mini-bin. An inquiry does not guarantee inventory, delivery, placement or suitability. Before a mini-bin booking, the customer and Bin and Gone must separately confirm availability, project type, accepted and prohibited materials, placement surface, access, timing, loading responsibilities, rental period, pickup arrangements, weight or fill rules, total price and any other applicable condition.
The customer must not assume that a road, sidewalk, shared lane or other public or third-party location can be used. Any permit or property permission responsibility must be stated in the project-specific agreement. Do not load, move or alter a bin except as allowed by the confirmed terms.
10
Project changes, cancellation and rescheduling
Tell Bin and Gone as soon as possible if the items, quantity, materials, location, access or timing changes. A material change may require a revised estimate, different equipment, another date or a decision not to proceed.
Any cancellation, rescheduling, deposit, no-access or refund rule must be disclosed in the specific booking before the customer accepts it. These website Terms do not create an undisclosed cancellation fee. Weather, unsafe conditions, vehicle issues, disposal restrictions or events outside reasonable control may require rescheduling, but Bin and Gone will communicate available next steps.
11
Payments, taxes and records
The website does not accept payment. The confirmed booking or invoice will state the price or pricing method, applicable taxes, any deposit, payment method and due date. Bin and Gone will not rely on these general Terms to impose an undisclosed deposit, card authorization, late fee, interest charge or collection fee.
Customers should keep the accepted estimate, change approvals, invoice and payment record. Questions about a charge should be raised promptly so the agreed scope and records can be reviewed.
12
Customer photos and project content
The customer confirms they are authorized to send project photos and grants Bin and Gone a limited permission to use them to assess, communicate about, perform and document the requested service. The customer retains their rights in submitted photos.
Sending a quote photo does not permit publication in advertising, social media, a portfolio or a case study. Promotional use requires separate permission. Avoid sending unnecessary images of people, documents, licence plates or private belongings. Personal information is handled under the Privacy Policy.
13
Website content, branding and external links
The website provides general service information and planning guidance. Municipal rules, facility requirements, availability and third-party information can change. Customers should verify time-sensitive rules with the responsible authority and confirm project-specific facts directly with Bin and Gone.
Bin and Gone branding, original text and owned images may be used only for ordinary personal browsing unless permission is given. Third-party photographs remain subject to their stated licences and credits. Do not copy, resell, scrape or use the Bin and Gone identity in a misleading way.
Links to government, municipal, social, mapping, messaging or other external services are provided for convenience. Bin and Gone does not control their availability, content, security, terms or privacy practices.
14
Responsibility, safety and legal rights
Bin and Gone performs only the confirmed scope and may stop work that appears unsafe, unlawful, unauthorized or materially different from the accepted project. Customers remain responsible for accurate authority, item identification and disclosure of known access or material hazards.
Website availability, external links and general guide information are provided without a guarantee that every page, device feature or third-party service will always be uninterrupted or current. Responsibility for an actual service is determined by the accepted project agreement and applicable law.
Nothing in these Terms excludes responsibility for negligence, wilful misconduct, personal injury, statutory warranties or consumer remedies where the law does not allow that responsibility or right to be excluded. These website Terms do not impose a liability cap, forced arbitration requirement or class-action waiver.
15
Ontario law and contract interpretation
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Disputes may be brought before a court or tribunal with jurisdiction in Ontario, subject to any mandatory consumer right or venue rule.
If one provision is found unenforceable, the remaining provisions continue to the extent permitted by law. A delay in enforcing a provision is not a waiver. Headings are for convenience. The accepted booking details and approved changes form the service agreement. These website Terms remain separate, and the Privacy Policy is a notice about information handling rather than a service-contract restriction.
16
Updates and contact
Bin and Gone may update these Terms prospectively as the website, services or legal requirements change. The effective date at the top identifies the current version. A material change will not rewrite an already confirmed project unless the customer agrees or the law requires it.
Questions about these Terms or the written details for a proposed job can be discussed by calling 289-356-0228.
